“It must intervene to fulfill its constitutional role in our tripart government”

Yesterday a federal judge in Seattle issued a temporary order forbidding enforcement of the God-King’s Yes-It-Is-A-Muslim-Ban:

The federal judge’s ruling, which was broader than similar ones before it, set up a high-stakes legal confrontation between the new president and the judicial branch over his temporary ban on entry by citizens of seven majority-Muslim countries as well as refugees. In his opinion, U.S. District Judge James L. Robart wrote that “fundamental” to the court’s work was “a vigilant recognition that it is but one of three equal branches of our federal government.”

“The court concludes that the circumstances brought before it today are such that it must intervene to fulfill its constitutional role in our tripart government,” he wrote.

Unlike previous rulings over the past week, this order blocks the God-King’s diktat nationwide, where at least 60,000 and as many as 100,000 visas have already been revoked. And this time the Customs and Border Protection agents seem to be listening:

Customs and Border Protection told major U.S. airlines Friday night they should go “back to business as usual” after a federal judge issued a temporary nationwide restraining order stopping President Trump’s executive order banning citizens of seven countries from entering the United States.

CNN reported Friday night that CBP held a 9 p.m. conference call with major airlines, telling them visas are being reinstated following the judge’s action.

An airline executive told CNN that CBP is “back to prior to the situation that was in place before last week’s executive order.”

Not surprisingly, the God-King was furious:

“At the earliest possible time, the Department of Justice intends to file an emergency stay of this outrageous order and defend the executive order of the President, which we believe is lawful and appropriate,” White House Press Secretary Sean Spicer said in a statement. “The President’s order is intended to protect the homeland and he has the constitutional authority and responsibility to protect the American people.”

A later statement deleted the word “outrageous.” But setting aside adjectives, that last sentence is a sweeping overreach. It may come shock to the God-King, but his election did not add USA, Inc to his business empire. While the Constitution defines his role as “Chief Executive,” that does not imply the unchallengeable authority of a corporate CEO. Nor does merely uttering the words “protect the homeland … protect the American people” shelter any mandate he might issue.

Simply, he can’t grab Lady Justice by the pussy. Her left hand may hold scales but the other holds a sword. Even blindfolded, she can find his hand and give it a good whack.

And she just did.
