Today the U.S. Supreme Court by a 6-2 majority upheld the Federal Energy Regulatory Commission’s ‘demand response rule.’ Under that rule, utilities must offer the same rates to customers who reduce energy usage in peak hours as they offer to power plants that boost production in those hours. The Court also let stand lower court rulings that blocked North Dakota’s six-week abortion ban, as they did last week with Arkansas’ twelve-week ban, and further limited life-without-parole sentences for juvenile offenders. Was this a good day for the Court?
