Today the Second Circuit Court of Appeals held that the NSA’s massive metadata collection program is illegal. In ACLU v. Clapper, the majority held USA PATRIOT Act did not authorize the NSA to collect metadata on Americans’ phone records without a warrant or even reasonable suspicion and a concurring opinion added constitutional and procedural concerns. The NSA metadata program will expire soon and today Sens. Patrick Leahy (D-VT) and Mike Lee (R-UT) said they will block any extension. Will Sen. John McCain howling “9/11!” change any minds?
