The D.C. Circuit Court of Appeals upheld the Affordable Care Act today. One judge said the court lacked jurisdiction to hear the case. The other, conservative jurist Laurence Silberman, alluded to the Civil Rights Act and concluded: “The right to be free from federal regulation is not absolute, and yields to the imperative that Congress be free to forge national solutions to national problems[.]” Three of four appellate courts to rule have now upheld the ACA. Will this decision make tomorrow’s front pages?
